AITION General Conditions (Company registration number: BE 0558844714), with its registered office in Eeklo, Patersstraat 45. www.aition.be and any subdomains are property of Koen Van den Berghe, who operates as a commercial entity under the name “Aition”.

 

1. General

1.1 These general conditions apply to the Aition web shop, to be found at www.aition.be. Products sold in the web shop include amongst others board games, card games, single cards, accessories etc...

1.2 These general conditions are applicable on all offers on www.aition.be . The conditions are accessible to all and included on www.aition.be . We can send you a written copy upon request.

1.3 By placing an order, you have acknowledged that you agree with the delivery and payment conditions. Aition reserves the right to change its supply and/or payment conditions after the term has expired.

1.4 Aition guarantees that the supplied product lives up to the agreement and complies with the specifications mentioned in the offer.

 

2. Supply

2.1 Supply will take place as long as stocks last.

2.2 All products are posted or can be collected on our main office address in Eeklo after making an appointment. The buyer will receive an email if the product is available for collection, or if it was posted to his/her indicated address. In case of delivery, the delivery charges may be charged as specifically mentioned with the completion of the order.

2.3 Orders are only sent once Aition has received the payment. Products to be collected are paid beforehand by bank transfer or cash at the moment of collection.

2.4 Aition shall execute orders at least within 7 days after receipt of payment. If this is not possible (because the ordered product is not in stock or no longer available), or there is a delay for some other reasons, or an order can not be carried out, or only carried out partially, the consumer shall be informed within 1 week after placement of the order and in that case he shall be entitled to cancel the order without being held liable for any expenses or any default notice.

2.5 Aition’s commitment to supply, unless proven otherwise, shall be fulfilled once the goods were handed over by the courier chosen by the buyer.

2.6 All periods stated on the internet site are indicative only. No rights may therefore be derived from the said periods.

 

3. Prices

3.1 Prices are not increased for the duration of the offer, unless statutory measures require this, or if the manufacturer implements interim price increases.

3.2 All prices on the site are subject to printing and type-setting errors. We do not accept any liability for the consequences of printing or typesetting errors. If an incorrect price was indicated by accident, we will immediately correct this and inform the buyer accordingly. The buyer shall always be entitled to cancel his purchase in case of a change in price.

3.3 All prices on the site are expressed in EURO and includes VAT.

 

4. Approval term / right to cancellation

4.1 If it involves a purchase by a consumer, the client has the right to return the goods supplied within a period of 14 days without any indication of the reasons. This period commences as soon as the ordered goods are delivered. If the Client has not returned the supplied goods to Aition after this period, the purchase becomes a fact. Before sending it back, the client is obliged to report this to Aition in writing. The client shall have to prove that the supplied goods were sent back on time, for example by means of proof of postage. The goods must be returned in the original packaging (including accessories and accompanying documentation) and still be in a new condition. If the goods were used or damaged by the client in any way, the right to cancellation within the meaning of this section shall expire. Considering that which was specified in the previous sentence, Aition shall ensure that the full purchase including the calculated shipping charges be refunded to the client within 30 days after proper receipt of the returned goods. Returning the supplied goods shall be entirely accountable to the Client.

 

5. Administration of details

5.1 If you place an order with Aition, your details are included in the Aition client base. Aition complies with the Privacy Act and shall not pass your details on to third parties.

5.2 Aition respects the privacy of its internet site users and is responsible for the confidential treatment of your personal details. The buyer can request these details at any time and delete or edit it if necessary.

5.3 Aition in some cases makes use of a mailing list. Every mail contains instructions on how to remove you from this list.

 

6. Guarantee

6.1 Aition guarantees that the products supplied by Aition complies with the efficiency, reliability and life expectancy requirements as intended in all reasonability by parties in the sales agreement, and thereby endorses the factory guarantee of the goods to be supplied to you, if a factory guarantee is applicable.

6.2 The client shall inspect the supplied goods immediately upon receipt. If it appears that the delivered goods are wrong, unacceptable or incomplete, the client shall immediately report these defects in writing to Aition (before proceeding to return it to Aition). Possible defects or incorrectly supplied goods can be reported to Aition in writing at the latest a maximum of 2 weeks after delivery. The goods must be returned in the original packaging (including accessories and accompanying documentation) and still be in a new condition. Using after discovery of the defect, damage arising after discovery of the defect, use and/or resale after establishing defects, shall cancel the right to complain and return the goods completely.

6.3 If client complaints are validated by Aition, Aition shall either replace the supplied goods free of charge or come to a written arrangement with the client concerning the compensation on the understanding that the liability of Aition and therefore the amount in compensation shall always be limited to at most the invoice amount of the relevant goods, or (subject to Aition’s choice) the maximum amount covered by the Aition liability insurance in the relevant case. Aition accepts no liability for any other form of loss, including additional compensation in any form at all, compensation for indirect losses or consequential damage or losses due to lost profit.

6.4 This guarantee does not cover (1) 'unpacked' products such as loose cards or (2) if the supplied goods were exposed to abnormal circumstances or otherwise treated carelessly or in contradiction with Aition’s directions and/or operating conditions on the packaging.

 

7. Special offers

7.1 Offers are obligation free, unless stated differently in the offer.

7.2 With the acceptance of an obligation free offer by the buyer, Aition shall be entitled to recall or change the offer within a period of 3 working days after receipt of the acceptance.

7.3 Verbal offers shall only bind Aition after this was confirmed specifically and in writing.

7.4 Aition offers do not automatically apply on repeat orders.

7.5 Aition can not be held to its offers if it should have been clear to the client that the offer, or a part thereof, contains an apparent mistake or typing error.

7.6 Additions, changes and/or further arrangements are only applicable when agreed to in writing.

 

8. Agreement

8.1 An agreement between Aition and a customer shall become valid after an online order was assessed by Aition on its feasibility.

8.2 Aition is entitled to refuse orders without indication of reasons or to only accept them under the prerequisite that the delivery shall take place on a COD basis or based on payment in advance.

 

9. Images and specifications

9.1 All images; photos, drawings etc.; including details on weights, dimensions, colours, images of labels, etc. on the Aition internet site only applies as a guideline, they are indicative and can not give rise to compensation claims or the cancellation of the agreement.

 

10. Force majeure

10.1 Aition can not be held liable if and for as far as its commitments can not be observed as a result of force majeure.

10.2 Under force majeure is understood any foreign cause, as well any circumstances that can not in reasonability be seen as part of its risk. Delays or non-performance of our suppliers, malfunctions of the internet, malfunctions in the electricity, malfunctions in e-mail traffic and malfunctions or changes in technology supplied by external parties, transport problems, strikes, government measures, delay in supplies, neglect by Aition’s suppliers and/or manufacturers as well as its assistants, illness amongst the personnel, defects in aids or means of transport applies specifically as force majeure.

 

11. Disputes /Applicable law / Jurisdiction of the judge

11.1 Possible complaints shall be reported to Aition by registered mail and within 7 calendar days after receipt of the goods.

11.2 Only Belgian law applies to all agreements.

11.3 The jurisdiction of the Court within the Judicial district of Ghent shall apply in case of disputes resulting from an agreement between Aition and the buyer that can not be solved in mutual discussion, unless Aition should prefer to submit the dispute to the jurisdiction of the Court of the physical address of the buyer, except for disputes falling under the jurisdiction of the justice of peace.
